What is the most efficient contractor tax leveraging for UK IT Contractors?

There are many contractor tax issues that face the high earning UK IT Contractor and other freelance workers today.

UK contractors are seemingly subject to new laws and regulations every other quarter in an effort by the HMRC to acquire or control tax avoidance.

Some IT contractors feel they have been penalised for being high earners, having worked their way into a position where they can charge high fees and then taking the risk of becoming self employed or a contractor they are still hit with the highest tax possible under british law.

For example working overtime or earning bonuses for hard work and good performance is rewarded with a staggering tax rate on any bonuses or overtime.

Recently there has been a bit of a turnaround where several contractors have won their cases against the HMRC who were being prosecuted for supposed contractor tax avoidance.

All this aside however let me tell you the purpose of this website /article on contractor tax, when writing it and researching all the best information I could find on this topic it became clear to me that there is a lot of confusion and debate as to what the best contractor tax arrangement is,  many people are fearful of falling under IR35, the old MSC laws and lately the anti EBT laws of December 2010

there are 3 main forms of tax structuring a contractor can take advantage of in order to minimise his tax burden. Umbrella companies, Limited companies and other tax advantage companies like offshore trust companies.

umbrella companies have some advantages for contractors tax liabilities and a big benefit with regard to how little administration a contractor would need to perform.

limited companies a lot of contractors now find themselves caught by ir35 and thus the tax leveraging once possible in minimizing your taxable salary and NI contributions was lost.  unless you have a very carefully structured /worded working relationship with the company you are providing your contracting services to. In addition the administrative burden and cost of an accountant also put a further dampener on this option.

The most efficient contractor tax leveraging:

offshore tax leveraging comes in the form of a trust company, in this instance you get the benefit of a umbrella company and the most attractive contractor tax leveraging possible, just be certain the company is not using an EBT, there are more recent structures where contractors become self employed thus avoiding the EBT announcement entirely.  The disadvantage is that most agencies will not deal directly with offshore companies.

In summary it is  in a position where it enjoys a unique status of being completely legal and outside all of the current laws keeping a contractor safe and deservingly earning the title of most efficient  contractor tax structuring possible.
